If you are a customer (a fisical person who purchases our products for purposes unrelated to the  conducted business or professional entreprise, and in such case does not buy indicating the partiva iva in the order form) the purchase agreement which you are about to conclude is disciplined, as far as what not specifically included in this general conditions, by the Legislative Decree  6th September 2005 no. 206 (Consumer Code) and by the Legislative Decree no. 185, 22nd May 1999, containing the consumers protection rules relating to sale contracts at distance.

“Stepstoperfection Limited Semplified Liability Company”, also comply obligations under the Legislative Decree 9th April 2003 no. 70 (Implementation of the directive 200/31/CE, related to certain legal aspects of the information society services in the internal market, with specific reference to electronic commerce).

ESSENTIAL FEATURES OF PRODUCTS

All the features of the ordered products, including their sale price, are listed on the online catalogue  and are visible when completing the order and before closing the contract.

All sale prices include V.A.T.

The picture of a product may not be perfectly representative of its features, but could differ according to color, size and accessories.

 

DURATION AND VALIDITY OF THE OFFER

The terms of each product's offer are those shown and visible on the on-line catalog at the time of completing the order before the contract is concluded.

The seller reserves the right to update the terms of the offer at any time and without notice, with the exception of products already ordered at the time of updating.

PRODUCT AVAILABILITY AND ORDER COMPLETION

Before proceeding with the order, we invite you to identify and correct any possible mistake during the completion of the fields and to carefully read  the general terms and conditions governing the sale and purchase, to print a copy of the same using the option “print” and to save a copy for personal use.

The order you send will be considered perfected and binding to the seller when, as a result of the transmission of the order, the seller himself will send you by email, a receipt about the receving of the order.

 

The confirmation message will include the identification number, the date of ordering, the indication of the purchased products, the relative price, the delivery costs and any c.o.d, the data provided by you for billing and delivery, of your chosen method of payment and a summary of the general terms and conditions of sale. Please check the content of the communication and report any errors or omissions right away.

The on-line order is executed by the seller except for the partial or total availability of the products you buy. In case of unavailability even temporary of one or more products, ascertained after the conclusion of the contract, the seller will inform you by email of the unavailable products, summarizing the order details (available products and quantities) and the consequent updating of the amount to be paid by c.o.d. or by bank transfer to be paid in advance, or by specifying that because of the unavailability of the purchased products, your order and the amount to be paid have been cancelled.
 

Acceptance of general conditions of sale

By submitting your order, you acknowledge and declare that you have read all the information provided during the purchase procedure and that you accept the general terms and conditions of sale.

METHOD OF PAYMENT

Currently Bormoline website allows its customers to purchase its  products through the following  methods of payment:

  • Bank transfer paid in advance: purchased products will be shipped as soon as our staff will verify that Bormoline's bank account has been credited. IBAN IT63F0306952290100000004, Banca Intesa Filiale di Tirano. The bank transfer should be made within five working days from the receiving of the email that certifies the receiving of the order. Please remember to sent a copy of the tranfer so that shipping can be speed up. The email address is info@bormoline.it.
  • Going in vain the term mentioned above, the order will automatically be canceled and will not be dispatched. The description of the bank transfer should indicate the name, surname, reason or corporate name of the owner of the order, the reference number of the order, the date of ordering.
  • Credit Card: through paypal you will be able to pay directly online, on a secure server, with your credit card, thus avoiding waiting the credit to be transferred on our bank account.
  • Cash on delivery: you will pay in cash when your goods are delivered to your address; in this case, a collection fee is payable for each order as defined in the order itself (or "equal to euro ...").

SHIPPING COSTS AND TIMES OF  DELIVERY

The delivery charges are paid by you, as indicated in the product catalogue and in the order receipt. The payment will be made using the chosen method indicated in the order.  We guarantee to deliver you the products as soon as possible and in any case within 30 days from the date of conclusion of the contract.

The seller dispatches the ordered products through the Italian Postal Service.

SDA Express Courier: delivery within 5 working days at the cost of Euro 7,50 vat excluded.

Shipments are handled according to the following criteria:

 

  • products purchased will be shipped the day after receipt of the payment by 18:00
  • products purchased on a saturday or on a sunday will be shipped the following monday by 18:00
  • products purchased on holidays will be shipped the following working day by 18:00

 

Stepstoperfection can not be held liable for any delays or damages attributable to the shipper.

 

 

We invite you to check the status of the parcel at the time of delivery. Any external damage to the packaging (damaged or open package, liquid trace, etc.) must be immediately disputed to the courier by indicating on the delivery receipt the damage detected.

DELIVERY REGIONS

All our products can be ordered and shipped in all Italian regions (islands included).

RIGHT OF WITHDRAWAL

If you are a customer and if you are not satisfied with the products you have purchased, you have the right to withdraw from the purchase of part or all of the goods of an order without any penalty and without the need to specify the reason, according to the article 64 D. Lgs. n. 206/2005.

To cancel the purchase, you will have to notify us within 14 days of receipt of the purchased products.

The communication must be made by registered letter with acknowledgment of receipt addressed to Stepstoperfection Limited Simplified Liability , via Tremogge no. 17, 23100 Sondrio (SO), or by e-mail, fax or telegram, to be confirmed within 48 hours with a registered letter with acknowledgment of receipt sent to the same address and specifying the products purchased, the relative order number and your will to withdraw from the purchase.

The sales service will respond by email and will give you a product return authorization code.

The shipment of returned products can be made by any means of your choice, within 10 days of the communication of the authorization code for the returned  goods. However, the seller will not accept return shipping at recipient's expenses neither at cash on delivery. Shipping charges will be paid  by the customer. Once you receive the items that are the subject of the withdrawal, the seller will promptly, and in any case within 30 days of receipt of your withdrawal registered letter, repay the sums paid for the purchase of the products.

 

PLEASE NOTE: The right of withdrawal may only be exercised if the goods are perfectly intact in all their parts and not used. Therefore, the returned products should not have been opened, the products wrap should not have been removed, nor bearing marks of tampering.

The seller will not be liable for any damage to the returned products during their way back. Should the seller receive damaged or tampered return items, he will not refund the amount paid for the purchase of the products.

In the event of damage to the goods during transport, we will notify you of the occurrence (within five working days of receipt of the product), in order to promptly raise your complaint against your chosen courier.

 

NOT-COMPLIANT AND DEFECTIVE PRODUCTS

 

If you a Stepstoperfection s.r.l.s. customer, we guarantees our products in accordance with article 128 et seq. of the Consumer Code and we take responsibility for any  compliance defect within two years of delivery.

You will be entitled to the repair, free of charge, of the conformity of the goods by repair and replacement.

In order to receive warranty service, you will need to keep the invoice you will receive by email and report the defect of compliance within two months from the date you discovered the defect, by registered letter with acknowledgment of receipt addressed to Stepstoperfection Limited Simplified Liability , via Tremogge no. 17, 23100 Sondrio (SO), or by email or fax.

How can I return a product?

For example: once the communication has been received, the sales service will contact you to communicate the modalities and the return number. We will send a courier to collect the product without any additional expense.

Once we have checked the product, we will provide replacement or repair and we will ship the product.

Any external damage to the packaging must be immediately disputed to the courier by indicating on the delivery receipt the damage detected.

COURT OF JURISDICTION

 

For civil disputes concerning sales contracts between the customer and Stepstoperfection concluded through the website, if the customer is a consumer, the territorial jurisdiction is responsibility of the court of the place of residence or domicile of the customer, where they are located in Italy.

In all other cases, territorial competence is indisputably the Sondrio Forum.
